Tool & Product Injuries

Whether intended for home, commercial or industrial use, products are expected to be designed and manufactured so that they can be safely used for both their intended use, and for other, reasonably foreseeable uses.

When someone is injured because of product design flaws, manufacturing defects or a lack of clear warnings regarding a product's dangers, victims and surviving family members have the right to seek compensation from the responsible parties.

I know from personal experience that not all products are as safe as they could be. Years ago I was seriously injured in a tool-related accident. I live with the effects of those injuries every day and believe the experience and consequences serve as an asset in my personal injury practice.

Product liability generally falls within one of the following areas:
  • Defective design: the design of the product is inherently unsafe
  • Manufacturer defect: an error of some sort during manufacturing results in a defect in a particular product (contaminated batch of aspirin, missing or damaged brake cable on a bicycle)
  • Failure to warn or inadequate instructions

Product liability cases usually require expert testimony in order to establish fault on the part of the manufacturer and/or the supplier. Cases based on defective design can be especially challenging primarily because defendants and their insurance companies are reluctant to open the floodgates to hundreds or thousands of other lawsuits.
